1. Introduction
Welcome to Miller Stone & Co Pty Ltd. These terms and conditions outline the rules and regulations for the use of Miller Stone & Co's website and the purchase of all of our Products. By accessing this website and/ or placing an order, you agree to these terms and conditions.
2. Definitions
"Company" refers to Miller Stone & Co Pty Ltd located at 1/ 1010 Pittwater Road, Collaroy NSW 2097.
"Customer" refers to any individual or entity purchasing products from the Company.
"Products" refers to the tiles and related items offered for sale by the Company.
3. Orders
Placing an Order: Orders can be placed online, by phone, or in person at our store. By placing an order, you are offering to purchase a product on and subject to these terms and conditions.
Order Confirmation: All orders are subject to availability and confirmation of the order price. The Company will confirm acceptance of your order via email or phone.
Order Cancellation: Orders can be cancelled within 24 hours of placing them without any charges. After 24 hours, cancellation fees may apply.
4. Pricing and Payment
Pricing: All prices are listed in Australian Dollars and are exclusive of applicable taxes unless otherwise stated. The Company reserves the right to change prices without prior notice.
Unless otherwise agreed in writing, all sales shall be made at the Company’s current price for the Product as shown on its current price list including any attachments or if applicable quotation, as issued by the Company to the Customer.
5. Stone and Other Material Production
Stone is a natural product, and variation is to be expected, it is what makes natural stone beautiful and unique. Quartz veins, tonal variation, batch variation, colour variation, fossils etc are nature's way of making your stone unique and desirable. Stone variations are not defects and we ask customers to understand that variation is to be expected. The Company accepts no responsibility to any minor variations between samples shown to the Customer and actual supplied Product. The Customer waives any claim against the Company for any such variation.
6. Force Majeure (extraordinary & unforeseen events)
The Company shall not be liable for any delay in the delivery due to any circumstances beyond its reasonable control, including, without limitation, any act of God, war, fire, breakages, breakages of machinery, strikes, shipping or arising out of any other unexpected cause, or cause beyond reasonable control of the Company.
7. Shipping and Delivery
Shipping Charges: Shipping charges are calculated based on the delivery location and the size/weight of the order and will be added to the total price at checkout.
Delivery Time: Estimated delivery times will be provided at the time of order confirmation. The Company is not responsible for delays caused by third-party delivery services.
Risk of Loss: Risk of loss or damage to products passes to the Customer upon delivery.
8. Claims
The Company shall not be liable in any aspect for advice given for the fixing, sealing or cleaning of goods, nor shall the Company be liable for any damages or losses incurred by the Customer as a result of the product purchased.
The Customer acknowledges and agrees that the Product supplied is to be installed or applied by experienced and licensed trades and that the application of the Product are within the relevant Australian Standards or manufacture directions of use.
All claims must be submitted in writing and within seven (7) days of delivery to site.
A site inspection fee will apply should no fault be warranted against Company of supply of the Product in the sum between $150-$200 within Sydney Metro. Additional cost also may be incurred beyond these areas at the Company’s discretion.
9. Returns
9.1 No indented material will be accepted for returns or cancellation once deposit is taken. 9.2 Returned Product or cancellation of Orders will have a twenty (20%) handling charge returns are to be of same tonality as in stock and no less than five (5) boxes or five square meters (5m2). All goods must be in original cartons, unopen, undamaged and accompanied by the invoice number.
10. Payment
10.1 Payment can be made via credit card, debit card, Amex, bank transfer, or other payment methods as specified on our website. Full payment is required before delivery of the products.
11. Liability
Liability: The Company's liability is limited to the purchase price of the product. The Company is not liable for any indirect, incidental, or consequential damages.
12. Important Information
12.1 The Customer must, before purchased a Product ensure that the goods are suitable and meet the requirements for the application and are in compliance with any relevant Australian standards.
12.2 Due to the composition of natural stone, manmade or clay fired products the Company recommends that you seek advice on installation, sealing and cleaning, as incorrect methods may result in damages of goods.
12.3 It is recommended that goods supplied are installed or applied by experienced and licensed trades, and that the applications of goods are within the Australian Standards and/ or manufacture directions of use.
